Montana Becomes The Fourth State To Ban Cultivated Meat

Montana will become the fourth state in America where cultivated meat cannot be manufactured or commercialized after Gov. Greg Gianforte signed legislation (HB401) that effectively bans such products.

The ban, which was sponsored by 24-year-old majority whip Braxton Mitchell, carries the threat of three months in jail and a $250 fine. A subsequent conviction would carry a maximum penalty of as much as six months in jail and a $500 fine. Establishments making or selling cultivated meat would also face suspended licenses.

“Montana is known for its world-class beef and ag traditions,” Mitchell said earlier this year from the House floor. “And I don’t believe allowing a product that even the Biden administration’s FDA said still needs to be further tested and evaluated to understand its long-term effects is a product that we should be supporting and endorsing as a state.”

The law takes effect October 1.

Florida became the first state to pass such a ban in 2024, with Gov. Ron DeSantis signing the bill into law on May 1. Alabama followed with its own law shortly thereafter, while Mississippi’s ban was made law in March. Indiana and Nebraska are expected to enact similar laws during the 2025 legislative session.
